•The customs convention related to the international cargo transportation on the roads (CMR )

In the month of May 1956 five European countries consist of Netherland, England, France and probably Belgium and Switzerland in order to uniform the conditions governing the international land transportation cargo contracts specially the documents used for the international carrying and the shippers’ responsibilities and their relationship with the cargo consigner and the receiver gathered in Geneva and prepared a bylaw consist of one introduction and 51 provisions with the title of (international land cargo contracts convention) CMR and all members signed it and they added a 12 provision correction amendment in July 1978 and in that way the responsibilities of the carrier companies towards the consigners and receivers were defined.

This convention is forcible in all land transports except the postal packages, the personal house furnishings and the corpuscles.

This document is issued in 3 main copies, the 1st. copy is for the consigner, the 2nd. One is for the receiver with the cargo and the 3rd. copy will stay with the carrier.

The main difference between CMR and FBL is that the BL is considered the possession document and is transferable and endorsement, CMR is not considered a possession document and we can’t go to the bank and receive the credit with that.

CMR is the observer between the consigner and the cargo receiver and is considered an insurance coverage for the carrier companies responsibilities and with the CMR insurance the carrier companies responsibilities are insured and covered and those companies are immune from any probable hazards.

If the transport vehicle carrying the cargo by the sea or local waterways or air in a part of the journey with the condition that cargo will not be discharged, it will be subject to these convention regulations.

In case that one of the origin and destination countries has joined this convention, they can use its regulations. Our country was using this convention before accession in its frame and was carrying cargos to the member countries and at present we issue CMR from our country to the new-autonomy countries as well as Turkey and Pakistan and versa which do not have this convention membership using this advantage.

 

•The customs convention related to the international cargo transportation on the roads under the TIR management

Any cargo which arrive to any countries is subjected to pay the customs dues and charges as the result the countries in order to stop these expenses not to be paid when carrying cargos or transit from their countries in the entering boarder of their countries after a careful cargo inspection receive cash money or heavy guarantees correspondent with the cargos kind and volume from the transport companies or the cargo owner and also re-inspect the vehicle at the time of cargo delivery or exiting the country and in case that the kind and volume is the same as the arrival time to the country, the cash or guarantee will be given back to them and because this process entails spending lots of time and expenses and possibly damaging the cargo during the inspection time, the European countries decided to find a solution for that and gathered together in 1959 in Geneva and after a complete consideration they created some regulations under the title of the international cargo transportation customs convention for the roads under the TIR supervisions from their agreement it was decided that the countries who were or would be the convention members, if they load or plump a piece of cargo on a vehicle under this convention’s conditions, that vehicle would be exempt from any inspections on the borders unless there are some suspicious matters and it wouldn’t be necessary for the vehicle to farewell a guarantee or pay any cash money and could pass all the borders only by showing its TIR card till reaching its destination.

In the year of 1975 the convention’s provisions were corrected or changed and at present the TIR provisions include 64 provisions and 8 attachments proctoring the shipper, customs and the guarantor and Iran joined the convention in 1963 and the international Iranian transportation companies can use the convention advantages by giving the necessary guarantees to the guarantor who is the Iranian trading, industry and mining and enjoying the convention advantages and transport cargos to all the convention member countries very easily.
